The formal registration of real estate transactions is one of the fundamental indicators of achieving sustainable economic and legal development. In Iran, the enactment of the Law on Mandatory Registration of Immovable Property Transactions represents the most significant systematic effort to transition from informal land ownership to legally registered property rights.
The main questions addressed in this article are: to what extent does Article 1 of the Law on Mandatory Registration have the capacity to create economic security and efficiency in the real estate sector, and what are the key requirements for its success? Does enhancing land tenure security through the issuance of official title deeds lead to tangible economic outcomes, such as improved access to credit and increased investment in land?
This study adopts a legal-analytical approach combined with an examination of international experiences to assess the potential of this law in fostering economic security and improving the efficiency of the real estate market. The findings indicate that strengthening land ownership security through the issuance of official documents can, under certain conditions, lead to better access to credit and increased investment in land, provided that the necessary supporting institutional and technological infrastructures are reinforced.
The results further demonstrate that the success of the law does not depend solely on the stringent enforcement mechanisms set forth in Article 1, but rather on the creation and enhancement of “institutional capacity” across legal, technological, and economic dimensions. At the same time, the implementation of the law faces challenges such as cultural resistance, the costs of institutional transition, and insufficient coordination among executive authorities.
