Abstract
In recent years, traditional models of financial service provision have undergone significant transformation, with stakeholders across global financial markets increasingly gravitating toward information-technology-based solutions for the delivery and utilization of financial services. The Islamic Republic of Iran, as a developing economy characterized by a young demographic profile and high Internet penetration rates, possesses considerable potential to capitalize on the advantages offered by FinTech. Nevertheless, the domestic experience over the past several years indicates that the evolution of this sector in Iran has been confronted with a distinct set of challenges and opportunities. Accordingly, conducting rigorous legal inquiries and identifying the constitutive elements of an optimal FinTech regulatory model—drawing upon the successful practices of leading jurisdictions—carries substantial scholarly and practical significance. This study aims to identify the dimensions and constituent components of an optimal FinTech regulatory framework through studying of the legal regimes of China and the United States, both recognized as frontrunners in this domain. The principal research question is: What are the constituent components of an optimal FinTech regulatory model., informed by the regulatory approaches of China and the United States? In terms of orientation, this research is applied in nature and adopts an inductive methodological approach. Thematic analysis, a qualitative analytical method, is employed for data processing. The findings of this study offer practical implications of considerable utility for FinTech regulatory authorities in Iran.
