Focusing on the concept of the “incommensurability of values,” this article analyzes the theories advanced in the philosophy of law and ethics regarding this phenomenon and, by examining models such as rational judgment, human agency, and bounded rationality, explains the possibility of reasonable and justifiable decision-making under conditions of value conflict. It then goes a step further and introduces a proposed hybrid model which, by combining interpretive methods, jurisprudential principles, and modern tools such as big data analysis, helps the lawmaker make responsible, accountable, and justifiable choices within the context of social commitments and cultural settings. By examining concrete examples of policymaking in the Islamic Republic of Iran, the article shows that a realistic understanding of incommensurability is not only an obstacle to decision-making, but can also open a path toward context-based rationality and institutional legitimacy. یکی از چالش‌های بنیادین در سیاستگذاری حقوقی، مواجهه با موقعیت‌هایی است که در آن ارزش‌های بنیادین نظیر عدالت، آزادی، امنیت یا کرامت انسانی در تعارض با یکدیگر قرار می‌گیرد و امکان سنجش یا ترجیح عددی میان آنها وجود ندارد. این مقاله با تمرکز بر مفهوم «قیاس‌ناپذیری ارزش‌ها» به تحلیل نظریات مطرح در فلسفه حقوق و اخلاق درباره این پدیده می‌پردازد و با بررسی مدل‌هایی چون قضاوت عقلانی، عاملیت انسانی و عقلانیت محدود، امکان تصمیم‌گیری معقول و توجیه‌پذیر در شرایط تعارض ارزشی را تبیین می‌کند. سپس در گامی فراتر، الگوی ترکیبی پیشنهادی معرفی می‌کند که با تلفیق روش‌های تفسیری، اصول فقهی و ابزارهای نوین مانند تحلیل داده‌های کلان به حقوق‌گذار کمک می‌کند تا در بستر تعهدات اجتماعی و زمینه‌های فرهنگی، انتخاب‌هایی مسئولانه، پاسخگو و توجیه‌پذیر داشته باشد. مقاله با بررسی نمونه‌های عینی از سیاستگذاری در جمهوری اسلامی ایران نشان می‌دهد که درک واقع‌گرایانه از قیاس‌ناپذیری، نه‌تنها مانعی برای تصمیم‌سازی نیست، بلکه می‌تواند راهی به‌سوی عقلانیت زمینه‌مند و مشروعیت نهادی بگشاید. https://nashr.majles.ir/article_11316_3798003c3d078a7b4fd1f33843a2e5c0.pdf
