Therefore, in order to address compensation for environmental damages and prevent similar occurrences in other wetlands, identifying the government’s civil liability in the drying of Lake Urmia is of critical importance. Using a descriptive–analytical legal approach, this article examines how the government can be held responsible for the lake’s desiccation and demonstrates that the three essential elements of civil liability are identifiable in this case: the existence of a legal duty, a causal relationship between governmental actions or omissions and the drying of the lake, and disproportionate or inadequate governmental measures to prevent it. Human factors played a greater role than natural factors in the drying of Lake Urmia, and these human activities were legally subject to government oversight. Accordingly, the government was obligated to adopt corrective strategies and exercise effective management and supervision over water, agriculture, and environmental protection in the Lake Urmia watershed.</span> <em><span lang="FA">یکی از مهم‌ترین عوامل انسانی مؤثر در خشک</span></em><em> </em><em><span lang="FA">شدن بخش اعظم دریاچه ارومیه مدیریت نادرست منابع آبی و امور کشاورزی در حوضه آبریز دریاچه و حفاظت ناکافی از محیط زیست آن بوده است. بنابراین به‌منظور طرح بحث جبران خسارت­های وارده و نیز پیشگیری از تکرار چنین رخدادی در دیگر تالاب­های کشور، شناسایی مسئولیت مدنی خشکیدن این دریاچه اهمیت دارد. این مقاله با روش توصیفی و تحلیلی حقوقی به بررسی این مسئله می­پردازد که چگونه می­توان دولت را در خشکیدن این دریاچه مقصر دانست و به این نتیجه رسید که ارکان سه‌گانه مسئولیت مدنی در مورد نقش دولت در پیشگیری از خشکیدن دریاچه یعنی داشتن مسئولیت قانونی، وجود رابطه سببیت میان اقدام‌ها و ترک فعل دولت و اقدام‌های نامتناسب دولت برای پیشگیری از خشکیدن این دریاچه قابل شناسایی است؛ چراکه عوامل انسانی سهم بیشتری نسبت به عوامل طبیعی در خشکیدن این دریاچه داشته­ و این عوامل انسانی هم قانوناً تحت نظارت دولت بوده که باید با اصلاح راهبردهای خود مدیریت و نظارت مؤثری در امور آب، کشاورزی و حفظ محیط زیست در حوضه آبریز دریاچه ارومیه داشته باشد.</span></em> https://nashr.majles.ir/article_10713_4d6ce445727ef59cc07abb95d3e4a1d4.pdf
